The Growing Misuse of Domestic Violence Laws Against Husbands & their families!

As a family lawyer, I’ve seen the Domestic Violence Act operate at both extremes. At its best, it has been a lifeline for women trapped in cycles of abuse, offering quick access to shelter, maintenance & protection.
But today, I see it more often at its worst .. used as a first strike by wives to corner husbands, block custody claims & create leverage for financial settlements.

This duality poses a pressing question for our legal system: How do we protect the vulnerable without punishing the innocent?

Courts are growing sceptical of such blanket allegations, often quashing cases against uninvolved relatives, demanding specific pleadings & imposing costs for false petitions. Yet DV proceedings designed as quick, summary remedies are ill-equipped to test credibility. As a result, false cases continue to drag on for years, draining the resources, reputations, & mental health of innocent husbands & their families.

How husbands can help themselves better -
For men caught in false DV cases, the instinct is often to fight fire with fire. But high conflict responses usually backfire. A more strategic approach is critical (easier said than done):
Document, Don’t React: Try preserving every message, transaction & interaction that shows the reality of your marriage.
Separate Facts from Emotion: Focus on inconsistencies in allegations rather than character attacks.
Shield Your Family early on: Courts are more open to quashing proceedings against uninvolved relatives.. elder parents / siblings etc
Challenge Misuse Systematically: Perjury applications, counterclaims for defamation, claiming damages & strategic quashing petitions can work if backed by solid evidence

False DV cases create three victims -
The wrongly accused men and their families
The legal system burdened with frivolous cases
Genuine survivors of domestic violence, whose credibility is undermined

To women considering filing DV cases:- remember this law was created as a shield not a sword. Every false / exaggerated complaint weakens its moral force & makes it harder for genuine victims to be believed
If there isn’t, don’t let anger / bad advice push you into litigation that destroys not just the other side, but your own credibility & peace of mind. The law protects, but misuse has consequences.. legal and karmic both
